Another Week in the World of Cannabis: June 24th, 2016

Cannabis is emerging from the shadows of prohibition. Every week, there are advancements in many fields related to cannabis. Cannabis Reports will be re-capping the weekly events of the cannabis community and industry, so that you can stay up-to-date on the latest developments.

NCIA Overview

The National Cannabis Industry Association hosted a very successful three-day event in Oakland this week, including a keynote speech by California’s Lieutenant Governor Gavin Newsom. He discussed the trends involving legitimacy and legalization for the cannabis industry, and warned that the battle for recreational cannabis in California is far from over.

There were many informative sessions throughout the week, as well as an exhibition floor with nearly 150 vendors displaying everything from cultivation hardware to accounting software and many things in between. Cannabis Reports will be publishing a complete overview of the NCIA event soon.

Congress Shoots Down Three Cannabis Policy Bills

Marijuana.com has reported that Congress released the Department of Veterans Affairs spending bill that did not include protections for veterans seeking cannabis options through the VA hospital system.

Additionally, Congress blocked a bill that would have provided a layer of protection for financial institutions taking business payments from the cannabis industry.

Finally, Congress blocked a measure Tuesday that would have allowed Washington D.C. to implement a regulated cannabis market. Despite cannabis being recreationally legal in our nation’s capital, Congress has refused any advancements in a structured industry.

Colorado Report Shows Teen Use Has Not Increased

The Colorado Department of Public Health and Environment released a report on Monday that shows child and teen use of cannabis has not increased over the four years since recreational cannabis became available in Colorado.

Class Action Lawsuit Against Michigan Laboratories and Regulators

A civil rights lawsuit has been filed against the Prosecuting Attorneys Association of Michigan and a number of other law enforcement groups that claims state laboratories were altering tests and filing faulty results that would indicate synthetic THC was present in seized cannabis products. Synthetic THC raises the criminal punishment to a felony.

Cannabis Businessman Denied Life Insurance

Derek Peterson is the CEO of Terra Tech Corp, one of the nation’s most established cultivation operations. Terra Tech is affiliated with several brands, including Blüm in Oakland, and is also one of the pioneer companies to offer stock options.

Mr. Peterson runs a successful and compliant business, so he was certainly surprised when Mutual of Omaha denied him a life insurance policy. While it is not clear why Mutual of Omaha did not grant the policy, a poorly-edited letter was received by Mr. Peterson that suggests the insurance company feared reprisal from an unnamed government agency.

Derrick Morgan Second NFL Player to Publicly Support Medical Cannabis

Derrick Morgan, linebacker for the Tennessee Titans, has become the second active NFL player to openly support medical cannabis research. Eugene Monroe, formerly of the Baltimore Ravens, was released last week by the organization.

Many people criticized the Ravens’ organization who claimed that cutting Monroe was purely a “football move.” The Tennessee Titans drafted Derrick Morgan in the first round of the 2010 draft, and have stated that Morgan is a valuable asset to the team.

Cannabis Charity Open – (Denver, CO: June 26)

Premium Pete’s Cannabis and High Rollers dispensary are partnering with The Hemp Connoisseur Magazine to host the Cannabis Charity Open benefiting the Denver Colorado AIDS Project (DCAP).

Epidiolex: Cannabis and Epilepsy

In a report released by the American Epilepsy Society, clinical evidence shows Epidiolex (GWPharma’s cannabidiol formula) to be highly effective for treating children with epilepsy.

The study, called “Efficacy and Safety of Epidiolex (Cannabidiol) in Children and Young Adults with Treatment-Resistant Epilepsy,” reviewed children suffering from Dravet Syndrome and other conditions marked by seizures over a 3-month period.

261 patients remained in the study for at least three months, which is long enough to collect substantial group data. 47% of all patients had a 50% or greater reduction in the number of seizures they experienced. 9% of total patients (13% of which suffered from Dravet Syndrome) were seizure free after three months with the medical treatment.

Safety data on the total 313 participants initially in the study was promising, with minimal Serious Adverse Events (SAEs) that were considered treatment-related. Still, nearly 34% of patients reported some instance of somnolence, diarrhea, fatigue, decreased appetite, convulsions, and vomiting.

Blüm Oakland Acquired by Terra Tech

Agriculture company Terra Tech Corp. (TRTC) has signed a major agreement to acquire all of the outstanding shares for Blüm Oakland, a popular retail location for cannabis in the Bay Area.

Blüm Oakland posted over $14 million in revenue over the past year, leaving participants in the stock market salivating over cannabis. The last day for closing this merger is March 31st, and Terra Tech has the option to cancel by March 1st should new financial information come to light.

Complain Filed for Shady Lab Results

Michigan crime labs have been accused of falsifying reports on cannabis to maintain public perceptions about the dangers of cannabis. Under the Michigan Public Health Code, possession of cannabis flowers is a basic misdemeanor, but possession of synthetic cannabinoids is a felony.

This growing scandal in which public officials conspired to misrepresent laboratory findings in order to secure stiffer penalties. The scandal has been driven by a series of email exchanges in which negligence and misconduct are strongly suggested.

At this time, no federal lawsuit has been published. The formal letter of complaint that has been submitted intends to expose the practices  of the Michigan State Police Crime Laboratory.

CA Governor Jerry Brown Still Has Not Signed New Medical Cannabis Laws

California Governor Jerry Brown has yet to sign the three cannabis bills that would regulate the medical cannabis industry in California. The Assembly and Senate both passed the bills with hours to spare. Now, the bills sit on the Governor’s desk, awaiting his signature of approval before they are implemented as California law. Gov. Brown has until October 11th to sign the bills. If the Governor does not sign the bills, they can still be chaptered and become law without the Governor’s signature.

Law enforcement agencies and members of the cannabis industry are urging the governor to sign the laws so that California can have a more legitimate industry with reduced crime and exposure to children. Several members of the State Assembly gathered outside of the Humboldt County Courthouse to show Gov. Brown that the bill has major support from Californians.

Michigan Medical Cannabis Regulation and Taxation Passes State Assembly

The Michigan State Assembly approved of new language that would create a regulated medical cannabis program in Michigan. House Bill 4209 is now being sent over to the Senate for approval. Like many recent examples of cannabis legislation, Michigan is proposing a tracking system for cannabis products so that there is no black market diversion. Licensing for legitimate business owners would also be instituted. The overall goal of the bill is to get cannabis to the level of other medicines. That means proper packaging, labeling, and industry transparency.

State of Ohio Sues the City of Toldeo Over New Decriminalization Ordinance

The Attorney General of Ohio, along with the Lucas County prosecutor and sheriff, have filed a lawsuit against the city of Toldeo over the recently passed “Sensible Marijuana Ordinance.” The measure decriminalizes cannabis use and possession to the absolute minimum, while still complying with Ohio’s drug scheduling definitions.

Over 70% of Toledo voters approved the ordinance in an effort to reduce jail time and fines for cannabis violations, prevent license suspensions, forbid cannabis violations from being reported to anyone above the local city attorney, and to prohibit criminal civil assets forfeiture. Ohio is preparing to vote on full cannabis legalization next month, so it seems that the Ohio Attorney General is making a last ditch effort to demonize cannabis.

First Cannabis Product Liability Lawsuit Filed in Colorado

In Colorado, two cannabis patients are suing LivWell Inc for using unapproved fungicide to grow their cannabis flowers. LivWell has nine dispensaries as well as a warehouse cultivation center. In April of 2015, Colorado officials quarantined 60,000 LivWell plants to test for pesticides and fungicides. They lifted the ban after only finding trace amounts of the fungicide Eagle 20, which also contains myclobutanil. Myclobutanil turns into hydrogen cyanide when burned.

LivWell claims that no consumer illness has been linked to their products, and that all exposed flowers have been phased out of the supply chain. Still, the two patients filing the suit, Brandan Flores (chronic back pain) and Brandie Larrabee (brain tumor), are claiming that they would have never purchased or consumed the products due to the health risks.

“They are only interested in pumping out large quantities of the product and not in taking time to nurture it. If they are willing to compromise your health to make a profit, then I say we hit them where it hurts, in the pocketbook.”

Canadian Research Team Publishes Study on Cannabis for Chronic Pain

A recent study conducted at McGill University Health Center in Montreal seems to provide more evidence that cannabis can be beneficial for chronic pain. Findings from the study were published in the Journal of Pain, called Cannabis for the Management of Pain: Assessment of Safety Study. The results point to cannabis as being an effective and safe long-term pain medicine to replace addictive opioids such as OxyContin and Vicodin.

The study followed 431 patients with chronic pain over the course of a year. 215 patients with chronic pain used medical cannabis, 216 patients did not use medical cannabis. There was no defined method for consuming the cannabis, although everyone received flowers containing 12.5% THC from hospital pharmacies. Researches found no difference in serious side effects, nor did they find evidence that cannabis is prohibitive of other medicines.
